Exemption – Questions 1(c), 2(c), 3(c)

We have determined that the information you have requested in Q1(c), Q2(c), and Q3(c) is exempt under Section 31(1)(a) of the Freedom of Information Act 2000 which says that information may be withheld if the public authority deems that its disclosure would, or be likely to, prejudice the prevention or detection of crime. The Council believes that disclosing this data would release detailed information which could lead to a cyber-attack, which are an ever increasing threat to public authorities, thus prejudicing the prevention of crime. Releasing this information would also allow potential attackers to determine the most effective public authority to attack and what type of attacks would be most likely to work. As the exemption is subject to the public interest test we have considered this accordingly. Whilst we recognise there is significant interest in this information, we consider that the public interest in maintaining the above exemption outweighs the public interest in disclosure. The Council believes that in this case the greater public interest lies in withholding the information in order to protect the confidentiality, integrity and availability of the Council’s IT infrastructure. This is in line with the advice issued by the Cyber and Government Security Directive, September 2016 and further supported by the National Security Risk Assessment (NSRA) where Cyber Security risk was increased in the light of these types of attacks against Central and Local Government in September 2019
