Scarborough Borough Local Development
Framework (LDF) – important changes to the on-going
process
In 2010 a new coalition Government was
elected, radically reforming England's planning system. It has made
significant changes to the planning system (most notably through
the Localism Act and the National Planning Policy Framework) that
affects the responsibilities of all local planning authorities.
One of the new Government’s key priorities is
‘localism’. The Localism Act (legislation that includes the
abolition of regional governance and the introduction of
neighbourhood planning) received Royal Assent in November 2011,
aiming to give local councils and people more powers over what
happens in their communities, in areas such as planning.
Consequently, The Yorkshire and Humber Plan (the Regional Spatial
Strategy, published in 2008) was formally revoked by Government on
22 February 2013.
The second component of the national reforms -
the National Planning Policy Framework (NPPF) - was published in
March 2012. This Framework replaces all existing national planning
policy contained in Planning Policy Statements and Planning Policy
Guidance notes with a single, streamlined document (it came into
immediate effect when it was published). This is a key part of the
reforms to make the planning system less complex and more
accessible, and to promote sustainable growth. The NPPF sets out
the Government's planning policies for England and how these are
expected to be applied.
The Council is in the process of producing
local policy documents as soon as possible to deliver the area’s
regeneration and development ambitions. In preparing new local
planning policies and allocations, it is essential that they are
framed in such a way as to accord with legislative requirements and
up to date national policy in order to withstand scrutiny at
examinations in public and avoid the need for early reviews.
Scarborough Borough Council had been working
on the preparation of a Local Development Framework to replace the
present Borough Local Plan (adopted in 1999). The Council had
prioritised preparation of a Core Strategy Development Plan
Document (DPD) and a Housing Allocations DPD. In light of the
changes to the planning system at the national level, the Borough
Council is no longer producing a Core Strategy DPD. On 17
January 2012, Cabinet agreed to the principle of rebranding the
'Local Development Framework'. The new approach is to produce a
'Local Plan' covering strategic policy, land allocations and more
detailed development management policies (essentially combining the
current Core Strategy, Housing Allocations and Community,
Environment and Economy DPDs).
All the evidence and consultation undertaken with the LDF over
the past few years will be taken into account and will shape and
inform the emerging plan. A detailed work programme (LDS) can be
found here, but it is anticipated that
a draft Local Plan will be published for consultation later
2013.
The Borough Council continue separate work on
an Area Action Plan (AAP) for Whitby Business Park jointly with the
National Park Authority.
A new element of the planning system is the concept of
‘Neighbourhood Plans’, whereby Town and Parish Council and local
groups can undertake the preparation of plans for their locality,
and ultimately make them part of the context for decisions on
planning proposals.
