Personal Search of the Local Land Charges Register

 

What is a personal search?

 

A personal search is an inspection of the Local Land Charges Register only.  It can be carried out by anyone, free of charge, on appointment.  

 

What is a Local Land Charge?

 

A Local Land Charge must be a restriction or prohibition on a particular parcel or parcels of land, either to secure the payment of a sum of money, or to limit the use (in the widest sense) to which the land may be put.  The most important factor is that the charge must be binding on successive owners or occupiers of the parcel or parcels of land.

 

What information is contained in the Local Land Charges Register?

 

There are 12 parts to the register:

 

Part 1 General Financial Charges
Part 2  Specific Financial Charges
Part 3  Planning Charges
Part 4 Miscellaneous Charges
Part 5 Fenland Ways Maintenance Charges (None in the this area)
Part 6  Land Compensation Charges
Part 7  New Towns Charges (none at the present time in this area)
Part 8  Civil Aviation Charges (none at the present time in this area)
Part 9  Opencast Coal Charges (none in this area)
Part 10  List of Buildings of Special Architectural and Historic Interest
Part 11   Light Obstruction Notices
Part 12  Land Drainage Schemes – Yorkshire Water will hold this information

 

 

How do I go about inspecting the Local Land Charges Register?

 

Please see the attached guidance notes (notes ) which contains the necessary information for you to undertake a personal search of the Local  Land Charges Register.

 

Can I submit requests to the Local Land Charges Unit for just this information?

 

Yes, you can submit request on a form LLC1 (available from Law Stationery suppliers) or alternatively, submit your request using the LLC Submission Form) The fee for this service is £28.

 

CON29"R" and "O" Enquiries

 

How do I obtain information to complete a fully complaint CON29"R" and "O"?

 

1. Provision of a CON29 Form (completed in whole or in part)

CON29 questions can be provided whole by completing the relevant CON29"R" and "O" forms available for Law Stationerys, or alternatively, but submission of your request on the attached forms LLC Submission Form   or PIU Submission Form

 

Request for partial CON29"R" information can be requested from the Council.  Requests should be made to Property Information  (propertyinformation@scarborough.gov.uk) on the above form.

 

2. Access to CON29 Data

Guidance upon accessing directly sources of information to complete the CON29"R" and "O" forms is found at (Property Information notes

 

Where information is not available on a public register requests for answers to individual questions to enable completion of the CON29 form can be made by email request made to the Property Information email address (propertyinformation@scarborough.gov.uk).  Answers are provided on a first come first served basis.
